SANTO DOMINGO.- The judge of the Criminal Chamber of the Duarte province, Arelis Camacho rejected the challenge presented against him by the lawyer of the family of Emely Peguero, José Hoepelman, alleging that he lacks impartiality to hear a habeas corpus petition filed by Marlín Martínez to obtain his freedom.
The magistrate adopted her decision on the understanding that there is no reason that affects impartiality to know the process because it is a constitutional right and not the merits of an ordinary process.
Likewise, the judge postponed the recourse without date, and ordered the clerk of court to forward the brief of the challenge to the Court of San Francisco de Macorís so that they decide whether or not to proceed.
In this sense, the judge established through a virtual hearing that if the Court understands that the challenge is appropriate, then that high court must empower another judge to hear the habeas corpus petition filed by Marlin.
Marlin, sentenced to two years in prison for hiding the body of the teenager killed by her boyfriend Marlon Martínez, son of the inmate.
According to the lawyer Ingrid Hidalgo, lawyer Marlín Martínez maintains that she suffers from hypertension and diabetes, diseases that were reported at the time of her admission to Rafey Mujeres, prior to the COVID-19 coronavirus pandemic.
